Welcome to TXGates. By accessing or using our website, purchasing products, or requesting our services, you agree to the following Terms & Conditions.

1. About TXGates

TXGates is a family-owned business based in Marshall, Texas, specializing in custom gates, fencing, signs, memorial products, fire pits, and other fabricated steel products. Many of our products are custom-built to customer specifications.

2. Orders

Orders may be placed through our website, by phone, email, or in person.

An order is not considered accepted until payment (or required deposit) has been received and production has been approved by TXGates.

TXGates reserves the right to refuse or cancel any order at our discretion.

3. Custom Products

Most products sold by TXGates are custom manufactured.

Because custom products are built specifically for each customer:

  • All dimensions, spelling, artwork, colors, and options are the customer's responsibility to verify before production begins.

  • Once production has started, changes may not be possible and additional charges may apply.

  • Custom orders are non-refundable except in the event of a manufacturing defect or an error made by TXGates.

4. Pricing

Prices are subject to change without notice.

Pricing errors may occasionally occur. If an incorrect price is displayed, TXGates reserves the right to cancel the order and issue a full refund.

5. Deposits & Payments

Custom orders may require a deposit before production begins.

Remaining balances must be paid according to the terms of your estimate or invoice.

Orders may not ship until payment has been received in full.

6. Shipping

TXGates ships throughout the United States.

Estimated shipping dates are estimates only and are not guaranteed.

Once an order leaves our facility, delivery times are controlled by the freight carrier.

Customers are responsible for inspecting shipments upon delivery and noting any visible freight damage before signing the delivery receipt.

Damage claims must be reported within 48 hours of delivery.

7. Freight Deliveries

Many products ship by freight.

Customers are responsible for ensuring:

  • adequate unloading equipment,

  • sufficient manpower,

  • safe access for the delivery truck.

Additional delivery charges caused by inaccessible locations or missed deliveries are the responsibility of the customer.

8. Installation

Unless specifically included on your invoice, products are sold without installation.

Customers are responsible for proper installation.

Improper installation may void warranties.

9. Product Variations

Because our products are handcrafted:

  • slight weld variations,

  • minor cosmetic differences,

  • wood grain variations,

  • natural steel characteristics,

  • powder coat texture,

are normal and are not considered defects.

10. Powder Coating & Finishes

Powder coating provides a durable finish but may experience normal wear over time.

Products installed near saltwater or in corrosive environments require regular maintenance.

Scratches, chips, and damage caused after delivery are not covered.

11. Warranty

Warranty coverage is limited to defects in workmanship and materials under normal use.

Warranty does not cover:

  • improper installation

  • abuse

  • accidents

  • misuse

  • neglect

  • acts of God

  • normal wear

  • rust caused by damaged finishes

  • unauthorized modifications

Specific products may carry different warranty periods.

12. Limitation of Liability

TXGates shall not be liable for any indirect, incidental, consequential, or special damages arising from the purchase, installation, or use of our products.

Our maximum liability shall not exceed the original purchase price of the product.

13. Intellectual Property

All website content including:

  • photographs

  • videos

  • logos

  • artwork

  • designs

  • product images

  • text

are the property of TXGates and may not be copied without written permission.

14. Website Information

We strive for accuracy but cannot guarantee that all descriptions, specifications, colors, or images are completely error-free.

Actual products may vary slightly from website photographs.

15. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Texas.

Any legal action shall be brought in the appropriate court located in Harrison County, Texas.

16. Changes to These Terms

TXGates may update these Terms & Conditions at any time without prior notice.

The most current version will always be available on our website.
